Terms of use and sale

These terms are the agreement between you and [Company legal name], [Company address] (registration number [Registration number], tax office [Tax office and number]), which runs Skorway. They cover using the site and buying passes and mocks. By creating an account or making a purchase, you accept them. Our privacy policy explains how we handle your data.

What Skorway is

Skorway offers AI-scored practice tests, practice sets and study plans for the TOEFL iBT. Skorway is not affiliated with ETS. TOEFL® is a registered trademark of ETS, and Skorway is not endorsed or approved by ETS.

Practice bands are estimates

The bands and feedback you get on Skorway are practice estimates, not official TOEFL scores. They are produced by automatic marking and by AI scoring against our rubric, and they can differ from the score you receive from ETS. We do not promise any particular result in the official test. If you think a Speaking or Writing score is wrong, choose "Ask for a re-score" on the feedback page and a person will review it and reply by email within three working days.

Your account

• You must be at least 16 to use Skorway. If you are under 18, you need a parent's or guardian's consent where the law requires it.
• You sign in with a 6-digit code sent to your email, or with Google or Apple where available. Keep access to your email account safe, because anyone who can read it can sign in.
• Your account is for you alone. Do not share it or let others take tests on it.
• Give us a correct email address so we can send sign-in codes and receipts.
• You can delete your account at any time on the Account page.

The free plan

Each person can have one free plan. It includes:

• one full mock test, fully scored;
• the first practice set of each task type (Speaking and Writing practice sets are scored only with a pass);
• the first week of the study plan.

Creating extra accounts to get more free mocks or practice sets is not allowed.

Passes and the single mock

• Passes: monthly ($19.99), 3-month ($44.99) and 6-month ($69.99). A pass gives full access for its period, including the whole study plan.
• One payment, never auto-renews. You pay once. A pass does not renew, and we do not keep your card on file. When it ends, your answers and history stay in your account.
• Passes in a row: if you buy a pass while another is running, the new one starts when the current one ends.
• Single mock: $4.99 for one full scored mock. If you buy a pass within 7 days, the price of the single mock is taken off the pass.
• Codes: teacher and coupon codes give a percentage off your first pass. Codes cannot be exchanged for cash.

Prices are shown before you pay. A pass or mock is ready to use as soon as payment is confirmed.

Payment

• In US dollars, payments are processed by Paddle, which acts as the merchant of record. This means Paddle is the seller of the order to you, adds tax at your country's rate and handles payment questions under its own terms, which you will see at checkout.
• In Turkish lira, with a Turkish card, payments are processed by iyzico, and you may be able to pay in installments.

Skorway never sees or stores your card number. Receipts are emailed to you and listed on the Account page.

Refunds and your right of withdrawal

• 7-day refund: you can get a full refund within 7 days of payment if you have not taken a paid mock with that order. Use the Refund button on the Account page. The money is returned to your card in 5 to 10 days.
• Your legal rights come first. If you are a consumer, the law of Türkiye (Consumer Protection Law No. 6502 and the Distance Contracts Regulation) or of your EU country may give you a right to withdraw from a distance contract or other remedies. Nothing in these terms reduces those rights. Our 7-day refund is in addition to them.
• If a pass or mock does not work as described because of a fault on our side, contact help@skorway.com and we will put it right, or refund you where the law requires.

Free weeks, referrals and teacher partners

• Report your official score: after your test, you can report your official score and get a free 7-day week. Your result is added to the public accuracy chart without your name.
• Give a week, get a week: when a friend you invite finishes their free mock, you both get 7 days of full access, up to 8 weeks a year for you.
• Teacher partners: teachers can get a free partner code. Students who use it get 10% off their first pass. The teacher earns 20% of every pass bought with the code for 12 months, paid monthly once the balance passes $20. Teachers see the reports only of students who agreed to share them.

We may cancel free weeks, discounts or commission obtained by fake accounts, self-referral or other abuse.

Taking a mock

The mock has Reading, Listening, Writing and Speaking, in that order, and takes about two hours. Each part has a timer kept by our server. The timer keeps running if you close the tab or lose connection, and when time runs out the part is submitted with the answers saved so far. Each Listening recording and Speaking prompt plays once. Please use a supported browser, a working microphone and a stable connection. If a technical problem on our side affects your mock, contact help@skorway.com and we will try to put it right.

Acceptable use

You agree not to:

• copy, record, publish, sell or share our questions, recordings, model answers or other test content;
• use bots, scrapers or other automated tools on the site, or try to get around timers, limits or payment;
• try to manipulate the AI scoring, for example with hidden instructions in your answers;
• upload someone else's voice or work as your own, or anything unlawful, abusive or harmful;
• interfere with the site's security or other users' accounts.

If you break these rules, we may suspend or close your account. Where the breach is not serious, we will warn you first. If we close your account without good reason, you will get a refund for the unused part of any pass.

Intellectual property

The site, questions, recordings, rubrics, feedback texts, model answers and the Skorway name and logo belong to us or our licensors. You may use them only for your own personal preparation.

Your answers, essays and recordings remain yours. You give us permission to store, transcribe, score and review them to provide the service and check scoring quality, as described in our privacy policy. This permission ends when you delete your account, except for anonymised statistics.

Availability and changes to the service

We work to keep Skorway available and accurate, but it may sometimes be unavailable for maintenance or because of problems outside our control. We may improve or change features. We will not remove a main feature of a pass you have already bought during its period without offering a fair refund.

Liability

We are responsible for loss that is a foreseeable result of our breach of these terms or our negligence. We are not responsible for results in the official TOEFL test or for decisions that universities, employers or others make based on your scores.

Apart from that, our total liability to you is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to liability for intent or gross negligence, for death or personal injury, or to any liability that cannot be limited by law, including your rights as a consumer.

Governing law and disputes

These terms are governed by the law of the Republic of Türkiye, and the courts and enforcement offices of Istanbul have jurisdiction.

If you are a consumer, this does not take away your rights:

• In Türkiye, you can apply to the consumer arbitration committee (Tüketici Hakem Heyeti) or consumer court for your place of residence or where the transaction took place, within the monetary limits set each year under Law No. 6502.
• In the EU, you keep the protection of the mandatory consumer laws of your country of residence and can bring a claim in the courts of that country.

Changes to these terms

We may update these terms, for example when the service or the law changes. We will tell you about significant changes by email at least 30 days before they take effect. Changes do not affect passes or mocks you have already bought. If you do not agree, you can stop using Skorway and delete your account.
